Consignment Agreement – Recycle Boutique

1. Agreement to Terms

By consigning items with Recycle Boutique, you ("the Consignor") agree to the following terms. Recycle Boutique Ltd 2005 ("the Company") reserves the right to amend these terms at any time.

2. Account & Identification

• The Consignor must provide a valid government-issued photo ID to open an account.
• The Consignor is responsible for securing their login details.

3. Item Acceptance & Processing

• The Company determines which items to accept for sale. The Consignor may choose to collect unaccepted items within 7 days or have them sent to our Donation Program. Please note, this option only applies to unaccepted items – any unsold items that have expired will not be held aside.
• A $4 processing fee applies per drop-off.
• The Consignor will be notified of accepted items via email and can check their account for updates.

4. Ownership & Authenticity

• The Consignor confirms they own or have the legal right to sell all items provided.
• Luxury designer items require proof of authenticity. If not provided, items may be priced lower, and the Consignor is responsible for any costs if an item is later found to be inauthentic.

5. Sales, Pricing & Commission

• The Company sets the sale price at its discretion.
• Commission rates:
• 45% of the final sale price for items under $100 (including GST)
• 55% of the final sale price for items $100 and above (including GST)
• Items remain for sale for 7 weeks. If selected for online sale, they stay online for 7 weeks before moving to a store.

6. Payment & Expiry

• The Consignor is responsible for tracking sales and requesting payments.
• Payments are processed within 14 days of request.
• Uncollected balances expire 2 years after the last sale.

7. Unsold Items & Withdrawals

• The Consignor may withdraw items before expiry by retrieving them in-store and notifying staff.
• Items not personally withdrawn by the end of the consignment period will become property of The Company and may be donated or sold at the Company’s discretion.
• Some items may be sold through Paper Bag Princess, with proceeds supporting cash donations to our primary donation partner.

8. Liability & Disputes

• The Company takes reasonable care of consigned items but is not responsible for theft, loss, or damage.
• The Consignor is responsible for tracking their inventory, sales, and payment collection.
• Automated notifications are provided as a courtesy but are not guaranteed. In the event that these notifications are not received The Company is not liable.

9. Amendments & Governing Law

• The Company may amend these terms at any time.
• This agreement is governed by the laws of New Zealand.

By consigning items with Recycle Boutique, the Consignor agrees to these terms.
